1. Introduction

Zensible Counseling Private Limited (“Zensible,” “we,” “us,” or “our”) is committed to protecting the privacy of everyone who uses our Services—including therapists, counsellors, psychologists, and their clients.

This Privacy Policy explains how we collect, use, share, and safeguard your information when you use our websites, applications, or other online services (collectively, the “Platform”), whether you are:

  • A Therapist User (mental health professional using Zensible to manage practice, clients, and related data); or

  • A Client User (an individual signing up to book sessions, complete forms, or interact with a therapist via Zensible).

By using our Platform, you agree to the terms of this Privacy Policy.

2. Scope

This Policy applies to all users in India. We comply with:

  • Digital Personal Data Protection Act, 2023 (DPDP Act)

  • Information Technology Act, 2000 & associated Rules on Reasonable Security Practices

We also follow industry-standard data security measures.

3. Information We Collect

We collect data differently depending on whether you are a Therapist User or Client User.

3.1 Information You Provide

  • Therapist Users:
    Name, contact details, professional qualifications, license/registration details, organization details, payment/billing information, and any other data you input into the Platform (e.g., therapy notes, schedules).

  • Client Users:
    Name, contact details, age/date of birth, gender, appointment history, responses to therapy forms or assessments, payment details (when applicable).

3.2 Automatically Collected Data (All Users)

  • IP address, device information, browser type, operating system, access times, and usage patterns (e.g., pages viewed, actions taken).

  • Cookies and analytics data for performance, security, and personalization.

3.3 Special Category Data

If you are a Client User, therapists may record sensitive mental health information in your session notes. Zensible processes this only on behalf of your therapist and does not use it for marketing or profiling.

4. How We Use Your Data

We use your data to:

  1. Provide, operate, and improve the Platform and Services.

  2. Facilitate communication between Therapist and Client.

  3. Manage accounts, subscriptions, scheduling, and payments.

  4. Maintain security, prevent fraud, and resolve disputes.

  5. Comply with legal obligations.

  6. Train and improve AI features only using anonymised/de-identified data—we never use identifiable Client data for AI training.

5. Legal Basis for Processing

We process your data under:

  • Performance of contract: To deliver the services you signed up for.

  • Consent: For optional services/features and for processing sensitive personal data.

  • Legal obligations: Complying with Indian laws, audits, and regulatory requests.

  • Legitimate interests: Improving our platform, security monitoring, and analytics (in compliance with DPDP Act).

6. Sharing Your Data

We may share data with:

  • Therapist ↔ Client: Information is shared as needed for therapy delivery (e.g., booking confirmations, therapy notes visible to your therapist).

  • Third-party service providers: Hosting, analytics, payment gateways (all bound by data protection obligations).

  • Legal authorities: Only when required by law or legal process.

  • Corporate events: In case of merger, acquisition, or sale, with notice to users.

7. Your Rights (Therapists & Clients)

Under the DPDP Act, you have the right to:

  • Access your personal data.

  • Request corrections.

  • Request deletion (subject to retention requirements).

  • Withdraw consent for processing where applicable.

  • File a grievance with our Grievance Officer.

We respond to requests within 30 days of verification.

8. Cookies & Tracking

We use cookies and similar technologies for:

  • Essential functions (logins, session management).

  • Performance and analytics.

  • Optional personalization.

You can control cookies in browser settings, but some features may not work without them.

9. Data Retention

  • Therapist Users: Data is retained as long as your account is active or as legally required.

  • Client Users: Data is retained until your therapist deletes it or as legally required. Zensible will not retain identifiable Client Data beyond the therapist’s instructions.

We implement reasonable security practices, including:

  • Encryption in transit and at rest.

  • Access controls and authentication.

  • Regular security audits.

11. Children’s Privacy

We do not knowingly allow persons under 18 years to create accounts directly without parental/guardian consent. Therapists are responsible for obtaining such consent before adding minors as clients.

12. International Data Transfers

Data may be processed outside India with contractual and technical safeguards ensuring compliance with Indian data protection standards.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date will reflect the latest version. We will notify users of material changes via email or in-app notice.
