1.        Introduction

These Terms & Conditions govern your use of Zensible Prototype (the “App”), a prototype tool designed to record and summarize therapy sessions while maintaining client privacy. This document also outlines the privacy policy regarding data collection, usage, and protection. By using this App, you agree to comply with these terms.

2.        Definitions

·      User – Any trainee or practicing mental health professional who utilizes the app as part of their therapy sessions with clients.

·      Client – Any individual who engages with a User for mental health services and whose session data may be recorded within the app.

3.        Purpose of the App

·      The App is a prototype meant to assist users and therapists in recording, transcribing and summarising client sessions with personally identifiable information removed.

·      To ensure privacy, recordings will not be publicly available after the transcription process is completed.

·      It is intended to assist therapists to review their sessions by generating conversation summaries.

·      The App does not replace professional documentation, medical advice, or formal record-keeping.

·      The App is designed to ensure privacy and compliance with data protection laws by not recording client names, personal identifiers, or other sensitive information.

4.        User Responsibilities

4.1   Ethical Use & Compliance

·       Users must use the App only for lawful and ethical purposes.

·       Users must comply with applicable privacy laws, including:

The Information Technology Act, 2000

Digital Personal Data Protection Act, 2023 (India)

Any other laws applicable in the user's jurisdiction.

4.2   Informed Consent

·       Users must obtain explicit verbal consent from the clientbefore recording a session.

·       If a client does not provide consent, users must record their own summary of the session in the prototype instead of recording the actual session.

·       Zensible is not liable if users fail to obtain proper consent.

4.3   Prohibited Conduct

·       Users must not use the App for commercial purposes.

·       Users must not attempt to extract, export, modify, or misuse recorded data.

·       Users must not share session summaries without proper authorization.

5.        Data Handling & Privacy

·      The App does not store or associate session data with any personal details.

·      All collected information is stored securely and kept private.

·      The system is equipped with end-to-end encryption to ensure data security.

6.        No Warranties

·      This prototype is provided on an “as-is” basis without any warranties, express or implied.

·      Users acknowledge that the prototype is free to use and may contain unforeseen issues.

7.        User Feedback

·      Zensible may reach out to users for honest feedback regarding their experience with the prototype.

·      Feedback collected will be used to improve the prototype and related services.

·      Zensible may publish user feedback publicly with prior written consent over email.

·      Users may publish their feedback about the App publicly after obtaining prior written consent from Zensible.  

8.        Limitations of Liability

·      The App is provided as is, without warranties of any kind.

·      We are not responsible for errors in the summaries or any decisions made based on the generated content.

·      We disclaim liability for any misuse of the App by users.

9.        Indemnity

·      Users agree to indemnify, defend and hold harmless Zensible, its affiliates, and employees from any claims, liabilities, damages, losses, or expenses arising out of the use of the prototype, including but not limited to violations of these terms or misuse of the system.

10.  Intellectual Property

·      All intellectual property rights related to the prototype, including but not limited to software, design, trademarks, and content, remain the exclusive property of Zensible.

·      Users are granted limited, non-exclusive, non-transferable license to use the prototype solely for its intended purposes.

·      Users may not copy, modify, distribute, or reverse engineer any part of the prototype without prior written consent from Zensible.

11.  Modifications & Termination

·      We reserve the right to modify or discontinue the App at any time without notice

·      Users violating these terms may be restricted from using the App

12.  Data Deletion Request

·      Upon receiving a valid request for data deletion from the User, Zensible will initiate the deletion process.

·      The data will be deleted within 7 working days from the date the request is received.

·      The deletion will be carried out in compliance with applicable privacy and data protection laws.
